A local elected official advises that mountain lions underscore local food sources.

From MPD comes a warning to residents that they have received recent reports of a mountain lion in the area:

There are unconfirmed reports that a mountain lion was spotted twice within the past two months in the area near Bladensburg Road and Banneker Drive.

This news is both exciting and cause for concern. Increasingly, the habitat for wild animals is reduced due to development for our needs. The Costco and Ryan homes projects consumed a considerable portion of habitat. It makes sense that a mountain lion would be seen in the Fort  Lincoln community because of the large deer population there, underscoring a considerable food source. I am intrigued by the numerous raccoons, foxes and  opossums that scamper up and down our streets after sundown; however  mountain lions are dangerous. If they are indeed in the area ( I believe they are) they are likely in the Arboretum and Fort Lincoln.

Does the Fifth District and Animal Control have a public safety plan to address this issue? What is the plan if someone shoots at a mountain lion as a result of a confirmed sighting? I recommend that 5D, Animal Control, DOH and DPW collaborate to create  a public service announcement to educate the public. It is imperative that citizens move quickly to properly containerize all trash as well as safeguarding small pets.

An update from an issue covered previously in May- local ANC Commissioner Kathy Henderson is back at it, warning citizen to not order from mobile meat vendor Capital Meats, which she claims employs potential burglars who are unlicensed for selling meat.  Capital Meats is a mobile meat delivery service, serving the greater DC area.

There have not been any public reports by police of criminal activity by the meat vendors, but Henderson’s ire has raised the attention of law enforcement.  And now, the police want you to call 911 if you see one of the familiar mobile meat salesmen.

Good Afternoon:
Please be advised that we are still receiving complaints regarding Capital Meats aggressively hawking their meat products in our community. Residents here have told us time and time again they do not want these unlicensed meat peddlers from Virginia knocking on their doors and pestering them to buy whatever they are selling. One of my neighbors was very concerned because the unlicensed seller “simply would not take no for an answer even when I told him no thank you…” This neighbor is home alone with a toddler and felt “very unsafe”. These individuals have been known to peer into windows to see if anyone is home. We are being subjected to a rash of break-ins and burglaries and these individuals could be culpable.
Again, we do not want them here, they are unlicensed in Virginia where they are from and they do not have a DC license. We want peace, order and quiet and prefer to purchase our products from reputable retailers, not unlicensed meat peddlers. We respectfully request our law enforcement partners to move them on when they see them anywhere in Carver or Langston Terrace and issue a citation for vending without a license. Thank you.

Capital Meats Inc. is based out of Winchester, Va. The District’s Department of Consumer and Regulatory Affairs (DCRA), last reported that its salesmen aren’t properly licensed to do business here in the District of Columbia.  To operate legally, the corporation would need to register with the city, and the salesmen would need licenses. There’s no record of Capital Meats.

Capital Meats relies on subcontractors to sell its products and subcontractors operating in eight states—Virginia, Maryland, West Virginia, Pennsylvania, Delaware, Tennessee, North Carolina, and Kentucky—but currently does most of its best business in the Baltimore and Washington Metropolitan Areas.

Commissioner Henderson Maligns MPD for Mystery Meat Malfeasance

On the MPD listserv, ANC 5D Chair Commissioner Kathy Henderson let MPD officials have it after perceiving they’d slighted her efforts to reign in alleged unlicensed meat peddlers.  It all started on Sunday afternoon, when the Commish tried to report what she believed was a crime in progress- selling door-to-door without a vendor license.  In addition, she somehow links the meat salesmen to theft and burglaries, e-mailing the MPD-5D listserv, in part:

There are two individuals canvassing the 1800 block of L Street NE, claiming to sell meat. One is wearing a pair of checker-colored shorts and a white t-shirt with no signage or lettering. The other is wearing a burgundy polo and shorts. Both are going onto neighbor’s properties and peering into windows; one stepped on flowers as he crossed into another yard.

This type of activity is suspicious. Over the years we have had robberies committed in the area by persons in uniforms claiming to be from Pepco, UPS, contractors etc. Many of these crimes were committed during the day. We still have too many burglaries and thefts in this community. Someone recently cut locks off of my neighbor’s gate and stole property. These individuals have not displayed any identification or license authorizing them to sell meat.

Last year, Henderson reported the same thing, and MPD officials asked her (and others) to call 911 when it occurs.  Understandably, the MPD list moderator replied back to let Henderson know it’s best to call 911 for crimes in progress, but that the information was relayed to on-duty officials, and therefore did not post the message publicly to the listserv of 5th district residents:

Apparently enraged at that response, Henderson replied back to let MPD have it, implied the meat company may be somehow linked to burglaries or other crimes, and also insulted the police listserv moderator. Henderson wrote:

I called the 911 dispatcher for police assistance regarding this matter. I appreciate the officers responding, asking the alleged meat vendors for identification and a license to sell meat in the District; they had no vending license and were thus sent on their way (presumably back to Virginia).

We do not buy meat from trucks, sofas from the sidewalks being sold by North Carolina vendors, etc. Further, we do not appreciate these unlicensed peddlers peering into our windows, stepping on our flowers or otherwise canvassing our community looking for opportunities to steal. We have been victimized by a host of characters claiming to be Pepco, Verizon, UPS etc. representatives. Instead of providing a terse and unresponsive reply, we expect the 5D outreach coordinator to be equally receptive to our concerns. The excuse for failing to post the message is unacceptable. The person serving as an outreach coordinator should at a minimum possess the ability to effectively interact with all members of the community. Thank you for your attention to this matter.

Henderson’s tirade unleashed a storm of messages, with several stating that the meat company is legit and has great products, and others launching false claims that the meat is uninspected by the USDA and one USDA employee even providing information on how to report such violations.

Yes, perhaps DC should crackdown if meat salesmen are registered out of state but not in DC.  Then again, there are many other examples of local “salesmen” (like the guy selling bags of charity-provided food for profit) that apparently go unnoticed by Henderson.  In addition, it’s at least disingenuous and possibly libelous to try to tie the meat salesmen to burglaries and thefts without any evidence of such a connection.

No stranger to allegations of libel, Henderson is currently being sued by two local businesses (Capital City Diner & Jimmy Valentine’s) for statements on listservs a judge deemed libelous.

Last night, ANC Commissioner Kathy Henderson complained publicly on the local MPD listserv about a charity food giveaway taking place in our neighborhood.  According to her allegations, police coordinated the event, which allegedly resulted in people streaming in from Maryland and diverting through traffic to stash “boxes of free food” into their cars.  She also claimed that the “chaotic” event diverted police resources, resulting in the theft of several items from a local community center.  Henderson’s email, along with cops’ response, is below:

Who is responsible for this chaotic event? One of my neighbors complained that someone robbed the Patsy Hartsfield Center of a flat screen television, computer and other property. He wanted to know why  officers are being diverted from patrolling our community to coordinate this event. Who identified this community for this activity? It appears the event is not focused to serve  people that actually reside in the ANC 5D community.

Is Central Union Mission randomly selecting communities for food giveaways? We need more police presence in the 19th Street and Benning Road area, the 800 block of 18th Street and at the Starburst Plaza that has been commandeered by aggressive persons that appear to be on drugs. We appreciate the work our officers do to make this community safe; we do not want any additional seemingly chaotic events that drain our police resources. I appreciate and look forward to a response regarding this matter.

Police Commander Solberg of the fifth district responded that he wasn’t aware of any nexus to MPD:

I have no knowledge of this event, and as far as I am aware it has no connection to MPD, but we’ll check.

Shortly thereafter, a police lieutenant also reassured residents that cops were only present due to the large number of people gathered, did not sponsor the event, and were not diverted from policing duties:

I do not know who was actually coordinating this event, however, PSA 507 members were merely giving special attention because of the amount of people responding. The special attention did not interfere with their normal patrols because that is an area we frequently patrol on a regular basis.

As a note, a previous reader question asked about a man selling what appeared to be bags of free-food-giveaway items in a local parking lot.  The Central Union Mission has provided similar food giveaways in past years, but no word yet on whether this event is related to them.

Medical Marijuana Dispensaries Prepare to Open; ANC5D Chair Says We’re “Dumped On”

The Washington Examiner reports that three local medical marijuana dispensaries are preparing to open soon, but are still facing backlash from the vocal Chair of Advisory Neighborhood Commission 5D, among others.  

The three dispensaries opening in the next month appear geographically dispersed: one in the Capitol Hill area of Eastern Market, one near NoMa  on North Capitol Street, and one in the Takoma neighborhood of Northwest:

Vanessa West, general manager for Metropolitan Wellness Center at 409 Eighth St. SE, said the facility pushed back its opening date to mid-April because it is waiting for a grower to produce marijuana to sell.

It is one of three businesses poised to begin accepting patients next month; the other two are Center City Care at 1334 North Capitol St. NW and Takoma Wellness Center at 6925 Blair Road NW.

However, the chair of local Neighborhood Advisory Commission 5D, Kathy Henderson, suggests that her area has too many dispensaries:

“Despite our vociferous objections, we were dumped upon, and the dumping upon Ward 5 has to stop,” Kathy Henderson, Advisory Neighborhood Commission chairman for Ward 5D, testified Wednesday. “There are other viable treatment protocols for citizens that are suffering.”

None of the three dispensaries mentioned in the Examiner article are anywhere near ANC5D; however, ANC 5D is home to one cultivation center, which is essentially a highly-secured and regulated greenhouse in an industrial-zoned area.

ANC 5D Hold Meetings at Location That Avoids Residents

Trinidad resident Geoff Hatchard posted a piece on Greater Greater Washington announcing that ANC 5D (the local representative body for the Trinidad and Carver/Langston neighborhoods) decided to hold its meetings in an area that avoids the residents it’s supposed to serve.

The Commission, chaired by ANC 5D05 Commissioner Kathy Henderson, decided to hold its regularly-scheduled monthly meetings at the 5th District Police Station, located outside of the commission’s boundaries, rather than at any number of public places available in the neighborhoods.

Of note, Hatchard points out that only about half of the residents in our neighborhood have cars, so many residents may not be able to attend.

From Greater Greater Washington:

The new ANC 5D, which includes the neighborhoods of Ivy City, Trinidad, Carver Langston, and Gallaudet University, will hold its second monthly meeting next Tuesday at a location outside the ANC’s boundaries. Why would the level of DC government closest to the people purposely meet at a place that makes it difficult for residents to attend?

There are multiple community spaces that could house meetings within the ANC: Gallaudet University, churches, two recreation centers, multiple schools, and other locations open to the public. It would be easy to find a place where residents could walk a couple blocks to interact with their elected representatives.

Open, honest government requires that citizens have easy access to public meetings, and it simply makes no sense for ANC 5D to hold meetings outside of the very neighborhood it represents, especially when more convenient meeting locations exist.

From local listservs, there’s a public safety meeting tonight hosted by ANC Commissioner Kathy Henderson.  In the below announcement, she lambasts MPD’s Commander Solberg and local police leadership.

MPD Requesting a Warrant for Henderson’s Arrest

A brief update to the Kathy Henderson case: A reliable source with collaborative access to the investigation, whose reporting has been corroborated in the past, reports that MPD investigators have wrapped up their criminal investigation into Henderson’s election day antics and have submitted paperwork to request an arrest warrant.  If the U.S. Attorney’s Office states it is willing to prosecute the case, the warrant application will go to a judge for final approval.

A poll worker and witnesses accused Henderson of electioneering and stated that she interfered with the voting process.  When they called the police on election day, Henderson allegedly called higher-up MPD officials to call off the officers and the officers left.  In addition, sources state Henderson filed a complaint against the initial responding officers.  A police source related that MPD officials initially sided with Henderson and nearly took the officers off the street, but canceled their investigations against officers once they saw our video online.  At that time, MPD stated to us that they were no longer involved and referred any questions to the Board of Elections, who then curiously stated it was in MPD’s hands.

Following a formal complaint by the poll worker to the Board of Elctions, the BOE referred the matter back to MPD, who investigated the allegations.

To be clear, this does not indicate guilt, but rather signals that MPD’s investigation has concluded.  More on this as it develops, but this is all we have as of this evening (Jan 14).

Tonight (Tuesday January 8) is the first ANC 5D meeting.  ANC 5D was formed during the recent redistricting following the census.  The meeting is at the 5th District MPD Headquarters (1805 Bladensburg Rd NE), although it is not located in the ANC 5D boundaries.

EXCLUSIVE: Judge Issues Judgment Against Kathy Henderson for Libel

We have learned that DC Superior Court Judge Christian just issued a judgment against well-known citizen/gadfly/former-and-recently-elected-Commissioner Kathy Henderson for her defamation of local bar Jimmy Valentine’s Lonely Hearts Club:

Plaintiffs’ Motion for Summary Judgment is granted with respect to JVLHC’s claim of defamation per se…Defendant’s Motion for Reconsideration is denied, and Defendant must remit the sanction in full on or before January 20, 2013.

Local businesses JVLHC LLC (Jimmy Valentine’s) and Ashburn Foods LLC (Capital City Diner) sued Kathy Henderson for defamation and libel, following Henderson’s infamous online postings wherein she lobbed accusations at the two local businesses online. However, Judge Christian dismissed Ashburn Foods’ claim on a technicality, stating that Henderson’s statements focused more on the diner’s owner personally, and not the business itself, allowing the diner’s owner to bring another suit at a later date.

The ruling further states that Henderson knew such statements were false at the time she made them, and that she made them in an apparent attempt to disparage the business. Such allegations included false postings made online to local e-mail list serves, as well as false complaints to the DC Alcoholic Beverage Regulation Administration and other city agencies.

Damages will be assessed at a trial to be held next year, but the judge has barred Henderson from providing testimony. In the meantime, the judge ordered that she pay sanctions that she was apparently previously ordered to pay in June for failing to obey an order:

If a party fails to obey an order to provide or permit discovery, a Court may require the party failing to obey the order to pay the reasonable expenses, including attorney fees, caused by the failure…the Court ordered Defendant to pay Plaintiffs $1,901.77 in attorney fees and costs, which the Court found were appropriate expenditures…allowing Defendant to pay $300 per month over a period of six months. At this time, Defendant has not paid any of this amount.

The plaintiffs were represented by local attorney Matthew LeFande, who specializes in civil rights litigation. According to his website, he “was previously appointed as a Special Assistant Corporation Counsel for the District of Columbia and as a member of the Metropolitan Police Department, serving for over fourteen years with numerous awards and service decorations, including an FBI Director’s Commendation for Heroism, the CHAMPS award, the Sustained Performance Award and the MPD Medal of Achievement.”

UPDATE: On the Ward 5 listserv, Henderson states that she “did the right thing and told the truth. I continue to believe my community deserves to be treated fairly and we deserve to enjoy a good quality of life. Unfortunately, there are some that have a different agenda and have no regard for our neighborhoods or me.” Of course, it appears the the judge disagrees with Henderson on this.
